Terms of Service

These Terms of Service (the “Terms”) govern access to and use of the Optic CRM platform (the “Service”), operated by TerraTender Services LLC, operator of Optic CRM (“Optic CRM,” “we,” “us,” or “our”). By accessing or using the Service, the business and its authorized users (“you”) agree to these Terms.

1. The Service

Optic CRM is a multi-tenant communications and customer-relationship platform for home-services businesses. It unifies conversations and leads across phone, SMS, iMessage, email, web chat, and connected lead marketplaces into a single inbox, with AI-assisted reply drafting, quoting, scheduling, and payment features.

2. Accounts & eligibility

You must provide accurate account information, keep credentials secure, and be responsible for activity under your account. You must be authorized to act for the business you register.

3. Your data & our role

As between you and us, you own the customer and conversation data in your workspace. You grant us the rights necessary to process that data to provide the Service. We act as your service provider/processor and handle your data per our Privacy Policy.

4. Connected platforms

The Service can connect to third-party platforms (such as Thumbtack, Angi, Networx, Google, Stripe, and Twilio) that you authorize. Your use of those connections is also subject to each platform’s own terms and policies, and you represent that you are authorized to connect each account and to permit the Service to access and act on its data on your behalf. We use connected-platform data only to provide the Service to you, and we honor each platform’s data requirements, including prompt deletion of API data on disconnection.

5. Acceptable use

You agree not to misuse the Service, including by violating any law or any connected platform’s terms, sending unlawful or unsolicited messages, attempting to disrupt or reverse-engineer the Service, or using it to process data you are not authorized to process.

6. Communications & compliance

You are responsible for ensuring that messages sent through the Service comply with applicable communications and consumer-protection laws (including consent and opt-out requirements). The Service provides tools to help, but compliance remains your responsibility.

7. Fees

Fees, if any, will be as agreed between you and us. Where no fee is stated, access is provided at our discretion and may change on notice.

8. Disclaimers

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that it will be uninterrupted or error-free, or that AI-drafted content will be accurate; you are responsible for reviewing content before sending.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months preceding the claim, and we are not liable for indirect, incidental, or consequential damages.

10. Termination & data deletion

Either party may terminate access at any time. On termination you may request export of your data, after which we will delete it within a commercially reasonable period, and we will destroy connected-platform API data within the timeframe described in our Privacy Policy.

11. Changes

We may update these Terms; continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.
